PJM Completes First Reliability Pricing Model Auction
PJM Interconnection reached a significant milestone in its development of a forward electricity market in April with the completion of the first annual capacity auction under its Reliability Pricing Model (RPM). Auction results were posted at the close of business April 13. (more)

PJM will be hosting a symposium to discuss demand response on May 10-11 in Alexandria, Va. Members were notified about the symposium on April 12. DOE Designates Two ‘National Interest’ Corridors
The U.S. Department of Energy (DOE) took a major step April 26 to address the nation’s transmission needs by issuing draft designations for two National Interest Electric Transmission Corridors (NIETCs) under the provisions of the Energy Policy Act of 2005. (more)

Highlights

PJM Completes First Reliability Pricing Model Auction

PJM Interconnection reached a significant milestone in its development of a forward electricity market in April with the completion of the first annual capacity auction under its Reliability Pricing Model (RPM). Auction results were posted at the close of business April 13.

Successful bidders in the auction included new generation resources and demand response resources.

“The auction went smoothly and participation was active,” said Andrew L. Ott, PJM vice president - Market Services. “Because they’re above the cost of new entry, the clearing prices in Eastern and Southwestern MAAC should create considerable interest from the investment community to add resources in these tight areas.”

“These results match the goals of the RPM to send pricing signals that will attract investment in new capacity resources where they are most needed,” Ott said.

The auction cleared 311 megawatts (MW) of new capacity (unit upgrades or new generating units) and 127 MW of demand response offers. A key feature of the RPM was the ability of demand response to compete with and to be paid the same as generation.

PJM’s first RPM auction began on April 2 and closed on April 6. It was for delivery of capacity during the 2007/2008 planning year (June 1, 2007 to May 31, 2008). The auctions procure needed capacity after participants have specified self-supply and contracted (bilateral) resources. As part of the phase-in to the RPM, two more auctions will be conducted this year. After that, annual auctions will procure capacity three years prior to the required need to provide opportunity for planned resources to compete to supply the needed capacity service.

PJM’s analysis shows that the RPM will yield lower costs overall than the previous model. Recent low capacity prices would not continue as supplies grow tighter because of load growth, generation retirements and lack of new generation construction.

PJM Holds First Demand Response Symposium

PJM will be hosting a symposium to discuss demand response on May 10-11 in Alexandria, Va. Members were notified about the symposium on April 12. Participants, who represent key stakeholders from a policy and market perspective, will discuss the evolution of demand response, its importance, best practices, barriers and opportunities.

PJM believes demand response is poised to become a significant contributor to grid reliability and power markets. PJM Interconnection is committed to working with its stakeholders to fully develop demand response.

This symposium will bring together the best minds in the industry and government to identify and develop consensus around approaches for implementing the most cost-effective and promising demand response products for the short- to medium-term. The symposium also will look at demand response products with longer lead times, e.g., through smart grid technologies and protocols.

In addition to Chief Operating Officer and Executive Vice President Audrey Zibelman opening the event, Commissioner Jon Wellinghoff of the Federal Energy Regulatory Commission (FERC) along with Dennis Wrasse of PHI will deliver the keynote address.

The symposium’s format and subject matter were guided by a working group composed of state and federal regulators, PJM members and other stakeholders. DOE Designates Two ‘National Interest’ Corridors

The U.S. Department of Energy (DOE) took a major step April 26 to address the nation’s transmission needs by issuing draft designations for two National Interest Electric Transmission Corridors (NIETCs) under the provisions of the Energy Policy Act of 2005.

One of the corridors, the proposed Mid-Atlantic Area National Corridor, affects the PJM region and includes counties in Ohio, West Virginia, Pennsylvania, New York, Maryland and Virginia and all of New Jersey, Delaware and the District of Columbia.

The DOE said the draft national corridors were designed to be large enough "to allow consideration of a wide range of potential transmission projects and routes by the appropriate transmission planning entities, siting authorities (e.g., state agencies and, under certain conditions, the FERC), and prospective transmission developers."

A 60-day comment period will begin the day the draft National Corridor designations are published in the Federal Register. During the comment period, DOE said, it will confer with the affected states and hold three public meetings on the corridor designations -- in the Washington, D.C., area on May 15, in California on May 17 and in New York City on May 23.

The 2005 energy law authorizes the federal government to designate the national transmission corridors, with the Federal Energy Regulatory Commission having backstop siting authority for transmission projects within them.

"We’re pleased that the Department of Energy has taken this important step in fulfilling the process the Congress created to protect the reliability of the electric power supply system," PJM said in reacting to the DOE announcement.

"The DOE’s independent evaluation of data has further confirmed the need for transmission additions in the region.

"Congress recognized the inherently interstate nature of the electric transmission system. In effect, it established an appeals process to protect the reliability of the system. States’ reviews of proposed transmission lines will proceed as normal.

The second corridor receiving draft designation from DOE was the Southwest Area National Corridor, which includes counties in California, Arizona and Nevada.

FERC Order on Reliability Standards

On April 19, 2007, FERC approved the NERC pro forma Delegation Agreement which includes a Compliance Monitoring and Enforcement Program to be used by NERC and regional entities to monitor, assess and enforce compliance with Commission-approved mandatory reliability standards. Among the elements included in the compliance program are procedures for audits and investigation, mitigation plans and remedial actions, procedures to address settlements, complaint procedures, confidentiality requirements, penalties, and hearing and review procedures. The order also approved the eight Regional Entity Delegation Agreements and related documents through which NERC will delegate authority to the regions for auditing, investigating and otherwise ensuring that users, owners and operators of the bulk power system comply with Commission-approved mandatory reliability standards.     On April 23, 2007, the Commission issued an order of Chief Judge re-establishing the Track II procedural schedule which had been suspended pending Commission consideration of the February 7, 2007, appeal.     On April 20, 2007, the Commission issued an order on rehearing and clarification on requests filed by ConEd and PSEG on a Commission opinion (Opinion No. 476, 108 FERC Para 61,120 (2004) (Phase II Opinion). The Commission reaffirmed its prior decisions in this case. This proceeding concerns two 1970's era contracts that provide for PSEG to receive up to 1,000 MW of power from ConEd at an upstate New York location and to redeliver the same amount of power to ConEd in New York City. The Commission denied both ConEd's and PSEG's requests for rehearing; however, the Commission clarified the opinion in one respect. As a condition for higher priority, the Commission stated that ConEd must elect to firm-up the 400 MW service and this 400 MW contract must be scheduled in the day-ahead set-up.

    On April 20, 2007, the Commission issued an order accepting informational reports on the performance of operating protocols used by two regional transmission organizations (RTOs), NYISO and PJM to fulfill long-standing contractual obligations of PSEG to wheel power 1,000 MW for ConEd through New Jersey into New York City. The Commission accepted all of the informational reports as filed and will not require any additional reports. The Commission also dismissed all of ConEd's requests for relief as procedurally infirm and rejected its request that the Commission institute hearing and settlement procedures. The proceedings in these dockets are terminated.

    On April 19, 2007, the Commission denied Old Dominion Electric Cooperative's ("ODEC") request for rehearing of the Commission's July 22, 2005 dismissal of ODEC's complaint against PJM Interconnection, L.L.C. that found that ODEC was not entitled to capacity credits for network upgrades built as part of a generation interconnection project.

    On April 19, 2007, the Commission issued an order (i) adopting a region-wide postage stamp rate for new facilities (both reliability projects and economic projects) at or above 500 kV, and (ii) conditionally accepting PJM's RTEPP cost allocations and expanding the scope of the cost allocation proceedings hearing requiring the parties to develop a detailed "beneficiary pays" methodology for new facilities below 500 kV (both reliability projects and economic projects) that will be set forth in the PJM Tariff (Docket Nos. ER06-1271, etc).

    On April 19, 2007, the Commission issued an order approving PJM's continued use of license plate rates and overruling the ALJ's initial decision to shift to postage stamp rates for existing transmission facilities (Order No. 494, Docket No. EL05-121-000). This is a companion order to an order issued the same day in PJM's RTEPP cost allocation proceedings.

    On April 19, 2007, in Docket Nos. ES07-22-000 and ES07-22-001, the Commission issued an Errata Notice to correct the first sentence in the first paragraph of the Letter Order issued April 17, 2007 to add the date the filing was supplemented and to add sub-docket number to the Letter Order.

    On April 18, 2007, in Docket No. EL07-56-000, the PJM Board of Managers addressed a letter to Chairman Joseph T. Kelliher and Commissioners together with a Statement to Management and Staff made by the PJM Board of Managers (Board) on Tuesday, April 17, 2007. The letter addressed the fact that the Board has undertaken an investigation of the allegations made by Dr. Joseph E. Bowring of the Market Monitoring Unit in testimony before the Commission at the technical conference on April 5, 2007.

    On April 17, 2007, in Docket No. ES07-22-000, the Commission issued a letter order authorizing PJM to continue to borrow funds under the secured promissory note in an amount not to exceed $110 Million, and to continue to borrow funds under a long-term, unsecured promissory note for a revolving line of credit up to $50 Million. Authorization is effective as of the date of this letter order and terminates on April 22, 2009.

    On April 10, 2007, the Commission issued an Order on Cost Allocation Report, Establishing Hearing Procedures, Consolidated Proceedings, and Holding Proceedings in Abeyance in PJM's Regional Transmission Expansion Plan (RTEP) in Docket No. ER07-424-000. PJM's revised tariff sheets are accepted for filing and suspended to become effective April 11, 2007, subject to refund. The Commission indicated a public hearing will be held concerning the justness and reasonableness of PJM's filing; however, this hearing is held in abeyance pending further order of the Commission. Docket No. ER07-424-000 has been consolidated with Docket Nos. ER06-456-000, -001 and -002, ER06-880-000, ER06-954-000 and ER06-1271-000. The presiding administrative law judge in the proceeding ongoing in these dockets shall determine the procedures best suited to accommodate consolidation.

    On March 30, 2007, the Commission issued a letter order accepting for filing the executed Wholesale Market Participation Agreement (WMPA) among PJM, Millennium Inorganic Chemicals (Millennium) and Baltimore Gas and Electric Company. PJM stated the WMPA was necessary to facilitate Millennium's intent to engage in jurisdictional wholesale transactions into its market.

    On March 30, 2007, in Docket No. ES07-22, PJM filed a supplemental application under Section 204 of the Federal Power Act seeking authority to continue to borrow funds, extend the draw date and the maturity date for an additional four year of the Secured Note in the amount of $110 million and authority to continue to borrow funds from the Unsecured Note for a revolving line of credit up to $50 million. PJM supplements its filing with additional financial documents that were unavailable at the time of the original filing.

    On March 29, 2007, PJM filed a Motion to Intervene in the Commonwealth Edison Company ("ComEd"), Docket No. EL07-41-000, proceeding in which ComEd filed a Petition for Declaratory Order for Incentive Rate Treatment ("Petition"). The Petition requests the Commission to issue a declaratory order approving specific incentive rate treatments for major transmission projects that ComEd has undertaken pursuant to the PJM RTEP.
