Stated Rate Plan Pays Credits to PJM Members
PJM is crediting refunds to its members as its rates continue to decline. A year ago, June 1, 2006, PJM instituted “stated rates,” fixed rates to recover the costs to run the grid control organization. The rate plan included a five-year series of rate cuts. (more)

COO Zibelman Leaving PJM for New Position
Audrey A. Zibelman, executive vice president and chief operating officer, has announced she will be leaving PJM Interconnection to become president and CEO of Nodal Exchange, LLC, a new organization designed to establish a variety of forward financial products for the power markets. (more)

Building Momentum with Demand Response
PJM sponsored a Symposium on Demand Response on May 10-11 to provide practitioners from across the region with the opportunity to discuss how to strengthen planning, analysis, and implementation of demand response (DR) programs, strategies, and techniques. The aim was to identify impediments, opportunities and actions for expanding DR and the role it plays in the region. (more)

PJM FERC Orders
05.21.2007 Docket No. ER07-231-001 (PDF)
On May 21, 2007, the Commission issued an order, under Docket No. ER07-231-001, accepting the tariff sheet revisions for the Procedure to Protect for Loss Phase II Imports, with an effective date of January 16, 2007. The Commission, in an early order issued on January 12, 2007, had previously approved the Procedure but directed the RTOs/ISOs to re-file it as Tariff Sheets under section 205 of the Federal Power Act and to comply with the Commission's Order No. 614 requirement. In this order, the Commission dismissed a protest filed by First Energy as a restatement of its original comments which should have been addressed in a request for rehearing of the January 12, 2007 Order.

On May 25, 2007, PJM filed an Answer to the Motion for Extension of Time filed by Joseph E. Bowring. PJM requests the Commission to carefully weigh whether the extension requested by Mr. Bowring is warranted, and if it grants any extension, it should extend the deadline for both PJM and Mr. Bowring.

Highlights

Stated Rate Plan Pays Credits to PJM Members

PJM is crediting refunds to its members as its rates continue to decline. A year ago, June 1, 2006, PJM instituted “stated rates,” fixed rates to recover the costs to run the grid control organization. The rate plan included a five-year series of rate cuts.

During 2007, PJM is crediting members’ bills with a total of $6.5 million, or approximately one cent per megawatt-hour. PJM’s management of costs allowed it to fully fund a financial reserve and to return savings to its members. Refunds during 2008 are expected to be approximately $40 million, or more than five cents per megawatt-hour. PJM’s composite rates to operate the grid and administer competitive wholesale electricity markets have declined by a third since 2003 – from 48 cents per megawatt-hour to 32 cents.

Before last June, PJM recovered its administrative costs through formula rates, which varied from month to month, depending on expenses. Now, PJM’s rates to recover administrative costs are fixed for a year at a time. Costs are managed within the fixed rates.

The rate plan includes a four-step structure of declining rates. Beginning June 1, 2006, the composite rate was 33 cents per megawatt-hour (MWh); beginning Jan. 1, 2007, 32 cents per MWh; beginning Jan. 1, 2008, 31 cents per MWh; and beginning Jan. 1, 2011, 30 cents per MWh.

Marginal Losses Being Implemented June 1

PJM will begin reflecting transmission system losses in the locational marginal price of electricity starting June 1.

Marginal-loss pricing, as it is called, reflects in the price of electricity the losses that occur as electricity travels over the transmission system from generators to load. As electricity moves over the transmission system, some of the electricity is lost through the dissipation of heat that’s produced in transmission lines and transformers. This means that less electricity is delivered than was produced by the generators; the generators therefore must supply more energy to cover the load and the losses.

With marginal-loss pricing in effect, dispatch procedures will change to minimize the losses on the transmission system when it is economic to do so, increasing efficiency. As a result, the total megawatts produced in order to serve the actual load plus the losses will be reduced, resulting in a lower production cost. The savings have been estimated at about $100 million a year for the system as a whole.

Preparations for the change have been under way since the Federal Energy Regulatory Commission last year approved the timing for implementing marginal-loss pricing. An extensive round of training, both in-person and online, was conducted for several months to help members and stakeholders prepare for the change.

COO Zibelman Leaving PJM for New Position

Audrey A. Zibelman, executive vice president and chief operating officer, has announced she will be leaving PJM Interconnection to become president and CEO of Nodal Exchange, LLC, a new organization designed to establish a variety of forward financial products for the power markets.

Since joining PJM in 2004, Zibelman has had primary executive responsibilities for PJM's management of system operations, planning and markets, member relations and overall company administration. Zibelman has more than 25 years of utility experience in both the public and private sectors.

Zibelman agreed to stay on through late June to complete the transition. No decision has been made concerning her replacement.

Building Momentum with Demand Response

PJM sponsored a Symposium on Demand Response on May 10-11 to provide practitioners from across the region with the opportunity to discuss how to strengthen planning, analysis, and implementation of demand response (DR) programs, strategies, and techniques. The aim was to identify impediments, opportunities and actions for expanding DR and the role it plays in the region.

The federal government favors expanded DR in the region, as do the states, utilities, and customers. The primary question is how to do DR properly and cost effectively. PJM is committed to getting DR right and to making it an even more integral part of regional electric system planning and operations in the years ahead.

More than 100 people participated in the symposium, including representatives from power companies, state and federal agencies, DR services providers, electricity customers, and PJM. The discussions covered both wholesale and retail markets. The proceedings from the symposium will be posted to www.pjm.com this month.

See upcoming announcements to register for forums in Fall 2007 focused on two important energy industry topics: long term contracting and addressing issues that exist between retail and wholesale electricity markets.

The two dockets concern complaints based on certain allegations made by the Market Monitor at an April 5, 2007 Technical Conference at FERC.

    On May 18, 2007, in Docket No. EL06-94-001, the Commission issued an order denying rehearing requests on the Commission's order denying the Borough of Chambersburg and the Town of Front Royal's complaint regarding the method used by PJM to allocate Auction Revenue Rights ("ARRs") for the 2006-2007 planning year. The Commission reaffirmed its determination that PJM properly applied the pro-ration provisions of the PJM Tariff and that the Commission and participants were on notice regarding how the provisions would be implemented.

    On May 17, 2007, the Commission issued an order confirming intervention in the Regional Transmission Expansion Process (RTEP) dockets for the Public Utilities Commission of Ohio ("PUC Ohio").

    On November 22, 2006, the Federal Energy Regulatory Commission ('Commission") generally approved PJM Interconnection L.L.C.'s ("PJM") long-term transmission rights ("LTTR") proposal, but required PJM to make a compliance filing proposing a LTTR full funding mechanism, and to separately engage in settlement discussions to develop revisions that would ensure LSEs received priority access to a minimum amount of LTTRs. In addition, the Commission required PJM to file rules that established procedures for granting LTTRs to parties that paid for transmission upgrades. On January 22, 2007, PJM filed a settlement that, among other things, guaranteed all stage 1A rights (i.e. LTTRs). On the same day, PJM made a compliance filing to fully fund all ARRs and FTRs, and to allocate any funding shortfall to all FTR holders on a pro-rata basis according to their target allocations. On February 16, 2007, PJM made a compliance filing regarding the rules to administer the granting of LTTRs to parties that funded transmission upgrades. In that filing, PJM stated the rules filed in Docket Nos. ER06-344 and EL06-67-001 met the relevant requirements of the November Order. On May 17, 2007, the Commission issued an order: 1) denying the rehearing requests filed in response to the Commission's November 22, 2006, order on PJM's initial LTTR proposal, and: 2) approving PJM's compliance filings and settlement filed in compliance with the November 2006 order. In the May 17th order, the Commission held that PJM and its stakeholders should develop rules related to external LSE's prospective eligibility for priority access to LTTRs, and should also re-visit the full-funding methodology and file a progress report on that issue by November 30, 2007.

    On May 15, 2007, the Commission issued an order of Chief Judge granting the motion to intervene of the New York Power Authority ("NYPA"). NYPA expressed that is has substantial interest in this proceeding that cannot be adequately be represented by any other party. No objections to NYPA's motion to intervene were filed. The intervention granted shall not be the basis for broadening the issues nor for delaying or deferring any matters in this proceeding.

    On May 15, 2007, the Commission issued an order granting intervention for the New York Power Authority ("NYPA") in Docket No. EL07-57-000 and all consolidated dockets.

    On May 4, 2007, the Commission issued an order an approving uncontested settlement agreement filed on behalf of Allegheny Power, PJM and the executing parties. This proceeding involved a dispute over the just and reasonable rate for PJM transmission service from AMP-Ohio's Richard Gorsuch Generation Station for the locked in period of April 1, 2002 through November 30, 2004. This order terminates Docket No. RT01-98-001 and the rehearing proceeding in Docket No. RT01-98-009.

    On May 3, 2007, in Docket Nos. ER07-632-000, -001, -002 and ER06-880-006, the Commission accepted for filing revisions to PJM's Open Access Transmission Tariff (OATT), effective May 7, 2007, as requested. PJM's proposed tariff revisions include a new Schedule 14, which provides the terms and conditions for transmission service over the Neptune Line. Additionally, revisions to Attachments L and T of the OATT identify Neptune as a PJM transmission owner and add the Neptune Line as a merchant transmission facility.

    On May 3, 2007, in Docket No. ER07-662-000, the Commission accepted for filing PJM's revisions to Rate Schedule No. 42 of the Consolidated Transmission Owners Agreement (TOA) with an effective date of May 7, 2007, as requested. As a result of Neptune Regional Transmission System, LLC (Neptune) receiving authorization to operate as a merchant transmission owner, Neptune has joined PJM as a transmission owner pursuant to which it will transfer operational control of the Neptune Line to PJM.

    On May 2, 2007, in Docket No. ER07-695-000, the Commission accepted for filing PJM's executed Interconnection Service Agreement (ISA) among PJM, PPL Shoreham Energy, L.L.C. The ISA sets forth the terms and conditions of the interconnection of PPL Shoreham's 3.2 MW generating station being interconnected to the PJM system in Lebanon County, Pennsylvania.

    On May 1, 2007 in Docket No. ER07-704-000, the Commission issued a letter order accepting for filing an executed nonconforming Network Integration Transmission Service Agreement (NITSA) between PJM and American Electric Power Service Corporation (AEP) that contained nonconforming language intended to clarify AEP's responsibilities under section 7.5 of the NITSA.

    On May 25, 2007, PJM filed an Answer to the Motion for Extension of Time filed by Joseph E. Bowring. PJM requests the Commission to carefully weigh whether the extension requested by Mr. Bowring is warranted, and if it grants any extension, it should extend the deadline for both PJM and Mr. Bowring.

    On May 25, 2007, PJM and the Midwest ISO jointly filed to revise the Congestion Management Process ("CMP") of their Joint Operating Agreement ("JOA"). Specifically, the RTOs revise the market flow thresholds contained in section 4 of the CMP from the current zero percent level to "the percent required per the NERC TLR standard." In this filing, the RTOs request that the Commission grant a shortened 3-day comment period for the CMP amendments to allow the revisions become effective on May 29, 2007, to correspond with the date PJM will begin the NERC approved field test changing the market flow threshold used by the IDC to assign relief obligations to the Midwest ISO, PJM, and SPP from the current zero percent to three percent for a 12 month interim period to evaluate reliability issues.

    The PJM Transmission Owners, acting through the Consolidated Transmission Owners Agreement, filed pursuant to Section 205 of the Federal Power Act, to revise Attachments R and X of the PJM Open Access Transmission Tariff to provide for how PJM shall implement SECA revenue distribution for all settlements approved by the Commission in the Seams Elimination Cost Adjustment ("SECA") proceedings. The tariff changes reflect an agreement reached among the PJM Transmission Owners for implementing revenue distribution for charges under settlements reached in the SECA proceedings by one or more PJM Transmission Owner.

PJM requests FERC accept the proposed revisions and waive the 60 day prior notice requirement, allowing them to become effective July 1, 2007.

    On May 8, 2007, PJM filed with the Commission a Motion to Intervene in the American Electric Power Service Corporation ("AEP") proceeding, in Docket No. QM07-4-000. AEP filed on behalf of its operating companies, requesting the Commission to issue a declaratory order determining that the operating companies of AEP located within PJM are not required, because of their location with PJM, to enter into new contracts or obligations to purchase electric energy from PURPA qualifying facilities rated greater than 20 MW of net generating capacity as otherwise required by under PURPA's mandatory purchase requirements.

    On May 7, 2007, in Docket No. ER07-868-000, PJM submitted revisions to section 6.4.2 to the PJM Operating Agreement that clarify the criteria for determining a generation unit's eligibility for relief under the offer price cap provisions as an "associated unit" or "AU". PJM requested an effective date of July 3, 2007.

    On May 3, 2007, PJM filed its answer to the complaint in Docket No. EL07-58, which concerns allegations regarding the PJM market monitor. In its answer, PJM showed that the complaint closely paralleled a similar complaint filed in Docket No. EL07-56, which PJM already had answered, and that FERC should not act on the market monitoring plan tariff changes that the EL07-58 complaint additionally sought, as PJM's Board was expected to complete its own review of market monitoring structure best practices in the near future.

    On May 1, 2007, PJM filed with the Commission comments following up on the Technical Conference on Seams Issues for RTOs and ISOs in the Eastern Interconnection under Docket No. AD06-9-000. These comments principally recommended that the Commission take certain actions to reform the method for managing loop flow consistent with the model offered by the MISO/PJM Joint Operating Agreement and Congestion Management Protocol.

    On April 30, 2007, PJM Interconnection, L.L.C. submitted an answer to the Complaint For A Show-Cause Order in Docket No. EL07-56-000 indicating that the Commission should dismiss the Complaint as unsupported or hold it in abeyance pending the PJM Board of Managers' investigation of statements made by the PJM Market Monitor.
