FERC finds no tariff violation, orders MMU settlement talks
The Federal Energy Regulatory Commission (FERC) announced on Sept. 20 that it found that evidence did not support allegations of tariff violations regarding relations between PJM management and the PJM Market Monitoring Unit. (more)

Long-Term Contracting Forum
More than 150 regulators, PJM members and industry representatives met to explore, define and exchange views on advancing long-term contracting capabilities in the electric industry at PJM’s Long-Term Contracting I Forum on Sept. 6-7. (more)

Duquesne Notifies PJM of Intent to Withdraw
In a letter to interim PJM President and CEO Karl Pfirrmann, Duquesne Light Co. notified PJM on Sept. 13 of its intent to withdraw as a member of the RTO. The Federal Energy Regulatory Commission must authorize the request before the action is final. PJM is in contact with Duquesne and other members to work with them in understanding the impact of the decision and to work through transition issues. (more)

On September 24, 2007, the Commission issued an Order in which it scheduled a prehearing conference, in Docket No. ER06-456-006, et al, that will be held on October 9, 2007 in order to clarify the positions of the parties, to explore the possibilities of settlement, and to set a procedural schedule adjudication regarding PJM and PJM Transmission Owners.

09.27.2007 Docket No. EL07-89-000 (PDF)
On September 27, 2007, PJM Interconnection filed with the Commission a Settlement Agreement and Offer of Settlement and related documents resolving all issues related to H-P Energy Resources LLC's ("H-P") complaint in Docket No. EL07-89, that was filed with FERC today, September 27, 2007. H-P's complaint related to the processing of H-P's merchant transmission interconnection requests assigned New Services Queue positions S119 and S120 and whether the projects satisfied the criteria to be offered as Qualifying Transmission Upgrades in the Reliability Pricing Model Base Residual Auction that commences on October 1, 2007.

Highlights

OPSI Annual Meeting. State regulators discuss common issues

Transmission, cost allocations, environmental issues and supply alternatives were among the topics discussed during panel sessions of the annual meeting of the Organization of PJM States, Inc. (OPSI) last month in Washington, D.C.

About 137 participants from the 13 states and the District of Columbia within PJM’s region gathered for the OPSI annual meeting. OPSI is a not-for-profit corporation comprised of state regulators. The meetings were held Sept. 20, 21.

Participants included state regulatory commissions and PJM member companies.

OPSI provides a platform for regulators to learn more about the grid and markets and to discuss issues that affect them. It is run by an independent board and has no reporting relationship with PJM.

FERC finds no tariff violation, orders MMU settlement talks

The Federal Energy Regulatory Commission (FERC) announced on Sept. 20 that it found that evidence did not support allegations of tariff violations regarding relations between PJM management and the PJM Market Monitoring Unit.

The commission found that PJM did not violate its tariff, but that the tariff might need to be modified to reform the relationship between PJM and its market monitor. The FERC directed all parties to enter into a settlement process. The commission also made a preliminary finding that the market monitor should report to the PJM Board of Managers or to an independent committee of the board, rather than to both the board and PJM management.

In response to the FERC decision, PJM said, “PJM looks forward to working with all parties to resolve the issues in this matter. The FERC order provides a framework that will enable us to move forward in the best interests of competitive wholesale electricity markets.”

The FERC will require an interim report on settlement progress within 45 days and a final report within 90 days. If there is no settlement at that time, the FERC will issue an order resolving structural and functional issues related to the market monitor’s ability to perform his duties.

Long-Term Contracting Forum

More than 150 regulators, PJM members and industry representatives met to explore, define and exchange views on advancing long-term contracting capabilities in the electric industry at PJM’s Long-Term Contracting I Forum on Sept. 6-7.

Among the many presenters and panelists were FERC Commissioner Marc Spitzer and Christine Tezak from the Stanford Washington Group..

The forum was the first of two designed to explore this important aspect of risk management in power markets. The second forum will be held in early 2008 in Washington, D.C. Registration information will be included in upcoming issues of this newsletter.

The proceedings from the first forum will be posted on line in coming weeks. The presentation materials and audio files for each session are available on the PJM Web site.

Duquesne Notifies PJM of Intent to Withdraw

In a letter to interim PJM President and CEO Karl Pfirrmann, Duquesne Light Co. notified PJM on Sept. 13 of its intent to withdraw as a member of the RTO. Since the notification, Duquesne requested that the FERC allow the company to withdraw from the October capacity auction for the planning year 2009-2010. On Sept. 28, the FERC denied Duquesne’s request to withdraw from the auction.

    On September 5, 2007, the Commission issued an order, in Docket No. ER06-554-003, accepting the Electric Refund Report that PJM filed in compliance with the April 3, 2007 Order which approved the settlement agreement between Virginia Electric and Power Company ("VEPCO"), Old Dominion Electric Cooperative, and North Carolina Electric Membership Corporation which resolved all disputes in the proceeding related to VEPCO's filing revising the revenue requirement for its provision of Reactive Supply and Voltage Control from Generation Sources Service ("Reactive Power") under the PJM Tariff, Schedule 2.

    In and order issued on August 31, 2007, the Commission dismisses the 206 proceedings (initiated by Order dated October 25, 2006 in Docket Nos. EL07-3-000, etc.) it brought against the various ISO/RTOs, including PJM, seeking to investigation whether RTO/ISO bidding and scheduling practices were optimal in light of pipeline nomination and scheduling practices.

    On August 30, 2007, in Docket No. ER07-1204, the Commission accepted for filing an interconnection service agreement among PJM Interconnection, L.L.C., DPL Energy LLC, and Dayton Power and Light Company, effective June 26, 2007 as requested.

    On August 29, 2007, in Docket Nos. ER07-424-000, et al., the Commission issued an Order On Request For Clarification Or, In The Alternative, Rehearing, in the RTEP cost allocation proceeding in which it granted ODEC's request for clarification. The Commission clarified that the scope of the issues set for hearing in Docket No. ER07-424 are consistent with the expanded scope of the hearing as described in the earlier April 19, 2007 order in the same proceeding. The Commission did not address the ODEC's request for rehearing as it was moot.

    On September 24, 2007, PJM filed in Docket No. ER05-1410, et al., compliance changes to the PJM Tariff to incorporate certain changes mandated by FERC's 12/22/06 order in the case. In that order approving the RPM settlement, FERC identified three areas in which the settlement afforded the PJM Market Monitor excess discretion, and ordered PJM to file changes in those areas to replace the Market Monitor's discretion with objective criteria, so that predictable results will emerge. As directed by FERC's order, the tariff revisions have an effective date of 4/1/08.
