On April 23, 2008, in Docket No. EL08-58-000, the Commission issued a Notice of Complaint regarding the Complaint filed Pepco Energy Services, Inc. ("PES") against PJM Interconnection, L.L.C. ("PJM") on April 22, 2008, alleging that provisions of PJM's Tariff as related to the rules governing the Peak-Hour-Period Availability Charge for infrequently-run generation resources under PJM's Reliability Pricing Model are unjust, unreasonable and unduly discriminatory.

Spotlight: Get to Know CEO Terry Boston

Terry Boston is a native Tennessean who married Brenda, from Nashville, 33 years ago. She was a public school science teacher with her own science television show. They have raised three children: Rachel, Andrew and Brian. Terry grew up on a farm before studying to become an engineer at the Tennessee Technological University, and he went on to earn his masters in engineering administration from the University of Tennessee after he started his 35-year career at the Tennessee Valley Authority.

He started there as a power engineer and after leading several large divisions became the executive vice president of Power System Operations, responsible for TVA'S transmission and power supply network of 17,000 miles of transmission lines and 1,058 substations.

Their children, who he often references, are grown and are either in college or working. Yet none of them are pursuing a career in energy. Brian, the youngest, is a geology major at the University of Wisconsin and is a rower for the university crew. Rachel is a professional actress who most notably starred in NBC's "American Dreams" based on "American Bandstand," set in the 1960s in Philadelphia. Andrew is part of Oxford University's rowing crew and is earning his masters in business. Prior to that, he competed in the World Cup for crew while at Harvard University for his undergraduate degree, where he also rowed on the Ivy League championship team and National Championship Team.

True to his passions around energy and technology, Terry Boston designed and built his house in Tennessee in 1988 with a passive solar installation, meaning there are no moving parts; it's partially heated by the sun. He had a conduit built at the time in the house for fiber optics, long before homes were regularly wired for broadband.

He sat down to share his thoughts about PJM and the challenges and opportunities he sees going forward.

What should PJM stakeholders know about your style?
TB: I am willing to listen and learn. I grew up in the control center and got new information every two seconds. You had to be flexible-able to change directions based on new information. I've also had a long history with being able to work with large member systems. There were 223 distribution companies and large industries at TVA. I strongly believe that customer service is not just and an organization or department, it is an important part of everyone's job at PJM. Respect for the individual and the customer is very important in building relationships with customers.

Should members be concerned that your TVA experience will give you a transmission and generation bias?
TB: No. I was actually on the trading floor for day-ahead transactions when I was 25. I directed the trading floor at TVA 2005 to 2007, doing about $1.2 billion in trading per year. Clearly most of my career has been focused on reliability. I have had a tremendous respect for those who are buying and selling power in the marketplace.

Have you met any of our federal regulators or state commissioners?
TB: Yes. I met all five FERC commissioners. I've met seven of the 14 OPSI commissions. I plan to continue visiting with them at their locations. I've had the opportunity to work with NARUC (National Association of Regulatory Utility Commissioners) through electricity forums. I even took training to become a NARUC commissioner when I was head of Pricing and Contracts at TVA.

How do you see your relationships with them developing?
TB: We have to see them as business partners. Clearly the FERC is our regulator, but the state commissioners, as well as the state legislatures, often have capabilities to influence both markets and state legislation.

It's very important to look at the potential of carbon legislation. I think carbon/climate challenge has the potential of changing the direction of transmission flows across the system. We really need to get our arms around the impact on reliability.

What are your thoughts on PJM's existing markets?
TB: The integration of markets and reliability is the principle that PJM is built on. We must do that well. If Mike Kormos and his team aren't successful on the reliability front-when the lights aren't on, nothing else matters, lights are out. If Andy Ott and his team aren't successful in markets that allow the grid to be reliable and produce economic benefits, we won't be successful.

We want to learn from others. I volunteered to be on the blackout investigation team of 2003 for that reason. In that same vein, we have someone from PJM sitting in on the investigative team for the recent massive outage in Florida to look at what led to the widespread outage.

We have a focus on the integration of markets and reliability here in PJM in the past and that focus will be strengthened in the future.

What role do you see for markets in PJM going forward?
TB: One thing we're going to have to follow closely, in addition to what we're doing now in both capacity and energy markets, what may happen with carbon cap and trade and its potential impact on the electricity market. Given that carbon will likely be high in the agenda for legislation, the total CO2 market economy-wide there may be more than the electricity market.

Some trade stories in the past suggested you might be less than enthusiastic about markets.
TB: I strongly support markets. I've been in markets for 35 years of my career. The statement I made at a FERC conference years ago was that I thought the Energy Policy Act of 1992 disintegrated planning between generation siting and transmission. That problem was basically repaired with Order 890 and regional planning came out of that. The comments that were made earlier were made about how the Energy Policy Act led us all to gas and the gas located at the pipelines, as opposed to those load centers that needed to be served. Lack of diversification of fuel was a problem following the Energy Policy Act of 1992. At the time that I was talking through this, not everyone saw it as a problem, and later it was proven to be one that was solved by Order 890.

What are PJM's biggest challenges?
TB: The largest challenge is to assure adequate infrastructure is built as part of the RPM market. We will get feedback in late May to see how successful we are in that effort. The Energy markets, Day Ahead and short-term markets are working very well. I've heard very few complaints from members, regulators and others on them. But how we have to ask ourselves how do we get baseload capacity built for the future?

The second challenge is that prices of the stuff power systems are made of are up. Steel is up 37 percent in one year. Aluminum is up 25 percent and copper is up by a factor of four in five years. And the fuel electricity is made from is up. In April, oil hit an all time record of $120/barrel and natural gas followed by going to $11/mbtus and coal costs are rising. As I shared with the PJM leadership team, it is likely that some people will blame the energy market for the rising prices.

How will PJM change to address those challenges?
TB: In the Operations environment, the AC2 project is going to give us the best tools in the world to monitor and control reliability and administer markets. The key is that we build it on schedule and on budget. In Markets, we have to listen and learn, especially to state commissions and to those who are criticizing markets. Our large industrial members have a lot of pressure on them for the worldwide competitive position they have. I'm also meeting with consumer advocates.

I'm reaching out to see where the differences are and how we can close the gap. And perhaps there are some things we can do together. In the case of APPA (American Public Power Association), they have tax exempt financing capability, and perhaps we can work with them on siting baseload generation.

Is PJM well positioned to deal with carbon legislation?
TB: If it's a tax, then it will just add to the cost of electricity. If it's a cap and trade then PJM is better positioned because we understand markets. CO2 is quite different than sulfur dioxide and nitrogen oxide because of the large volume of the materials that is produced. The issue is how do you geologically capture and store it-CO2. It's a technology issue that has not been solved.

Electricity is the economic engine for any country-as is evident in the growth of China and India. Electricity is the fuel of economic growth, and we must find solutions to the technology problems. And perhaps there are also viable market solutions, for example plug-in hybrid vehicles which would reduce the dependence on foreign oil, as well as reduce the mobile source-the major emitter of CO2.

Back some months ago, before coming to PJM, I witnessed the demonstration of the V2G car in Washington by a FERC commissioner. I'm on the steering committee appointed by the Department of Energy to advance plug-in hybrid vehicles.

What keeps you up at night?
TB: If you think of the risk of loss of life that would happen with a blackout, assuring we've done everything in our power for near-perfect reliability is paramount in my focus. Always has been. We're fortunate that when the blackout happened in 2003, it was not extraordinarily hot or cold, in terms of potential risk of loss of life. It was about 84 degrees.

It has been five years since the blackout, what has changed and what yet needs to be done?
TB: The root cause of the August 14, 2003, blackout was a combination of trees and computer failures. If you think the cost of electricity is high, you should see the cost of not having it for a day. It was a $6 billion day in lost productivity and the societal cost.

The largest change since then has been that reliability standards have become mandatory instead of voluntary, and that was part of EPACT 2005. We now have available to us phase angle measurements, and so, we have much better ability to determine when the system is going to be unstable, as opposed to 2003. The new devices we are deploying can take 30 samples per second. The scan rate on SCADA (supervisory control and data acquisition) is every two seconds or every four seconds. It's kind of like comparing an MRI to an X-Ray. So we have much better data coming into our control centers. We are just now developing the tools to integrate that into state estimators. I see a future world where we will have a state "measure," not just a state estimator.

Unfortunately, the memory of the blackout has faded tremendously. There is not as much fear about it happening again. It can happen again. Our goal is to make sure it doesn't happen again.

Andrew Ott promoted to Senior Vice President

The Board of PJM Interconnection has promoted Andrew Ott to the post of senior vice president – Markets. The announcement was made today at PJM’s annual members meeting in Williamsburg, Va. Ott previously was the vice president – Markets. Ott, who joined PJM in 1996 from GPU, was responsible for implementation of PJM’s locational marginal pricing, financial transmission rights and the Day-Ahead Energy Market systems. He received a Bachelor of Science degree in electrical engineering from The Pennsylvania State University and a master of science degree in applied statistics from Villanova University.

PJM Demand Response Symposium II Set for May 12-13

Demand response is poised to become a significant contributor to grid reliability and power markets. In a follow-up to an earlier symposium on demand response, PJM will host a second symposium on May 12-13 at the BWI Airport outside Baltimore.

The goal of the second demand response symposium is to develop specific action strategies and identify champions for implementation of the demand response roadmap, which was developed in the first symposium, to guide coordinated retail and wholesale market development of demand response. Workshop attendees will participate in short plenary sessions and then work in parallel breakout groups to discuss and develop an action plan to implement three important areas of the demand response roadmap for the PJM region.

PJM Emerging Energy Resources Forum May 16

On May 16 participants of the newly formed PJM Emerging Energy Resources (PEER) forum will explore wind, landfill gas, solar and recycling facilities at the Atlantic County Utility Authority's site in Egg Harbor Township, N.J. (near Atlantic City).

Participants will learn more about the California ISO's wind integration and forecasting method and metering options through the Generation Attribute Tracking System (GATS) in PJM. They will hear presentations on thermal storage, demand response and battery storage.

Standards Review eRoom
PJM is creating an eRoom to be used for collaboration on standards review. NERC and regional standards that are out for comment will be posted to the eRoom so users can review the documents, post their comments, and review the comments of others. Users can subscribe to the eRoom by visiting the site. PJM plans to migrate this site to a SharePoint site this Summer.

NERC
Per the March 2008 NERC News, NERC announced key goals for the organization that include:
- Complete 10 Standards Work Plan Projects, to include Violation Severity Levels and the Available Transfer Capacity standards.
- Successfully manage the Compliance Monitoring and Enforcement Program by balancing the importance of self-reports, mitigation plans, and 100% compliance with the standards at all times; ensure that Regional Delegation Agreements are executed efficiently and effectively; and implement a compliance reporting tracking tool, as well as a knowledge sharing program for the industry.
- Issue at least one advisory, recommendation, or essential action to the industry per month as a result of a completed event analysis; present results of individual event analyses, as well as trends, on a quarterly basis to NERC committees and the Transmission Forum.
- Finalize and begin to implement the Reliability Assessment Improvement Plan to improve the quality and breadth of NERC's season and long-term reliability assessments.

NERC's Operating Committee approved a key report addressing Recommendation 22 of the U.S.-Canada Power System Outage Task Force's 2004 Final Report, which specified the need to evaluation and adopt better real-time tools for operators and reliability coordinators. These recommendations include:
- 40 revisions to existing NERC standards;
- 16 operating guidelines; and
- 17 areas that require more analysis.
NERC has implemented new software for faster processing of comments and nominations. This new online tool allows users to submit their responses online in an easy-to-use format. Some benefits of this new technology, per NERC, include:
- greater security of data a fewer errors;
- E-mail confirmation to respondents upon submittal, including responses that verify that NERC received it;
- Answers can be saved and edited at a later date before submittal; and
- Answers are editable at any point before the comment period closes.
NERC's Education Program continues for industry-wide education and learning opportunities including the monthly Webinar series and training for compliance and readiness volunteers.

As part of the overall readiness evaluation process, NERC gathers feedback from volunteers who participate on readiness evaluation teams. An analysis of their feedback reveals a positive response: volunteers consistently report the experience was beneficial and they would be willing to participate on future evaluations.
RFC

The 2008 RFC Compliance Seminars will be held in June 2008:
Baltimore, MD on June 10 and 11
Columbus, Ohio on June 17 and 18
Chicago, Illinois on June 25 and 26.
FERC recently issued an Order directing NERC and the eight Regional Entities to make some conforming changes to the agreements governing the relationship between NERC and each Region. RFC does not believe that any of the changes are fundamental and they received permission to operate under the existing agreements until the amended ones can be prepared.

The RFC Critical Infrastructure Protection (CIP) Subcommittee is sponsoring a Workshop of the NERC CIP Standards (CIP-002 - CIP-009). This workshop will focus on the CIP Standards with the overarching objective being to provide examples of how Registered Entities within RFC are approaching compliance to these standards and a forum for the exchange of ideas on implementation of the standards. The Workshop will be held June 9-10, 2008, at the Cleveland Airport Marriott hotel located at 4277 West 150th Street, Cleveland, OH 44135. Registrations must be received by RFC no later than May 30, 2008. More information is available on the rfirst.org website.

The RFC Regional Standards Voting Process site has been updated to align itself with the current RFC Reliability Standards Development Procedure, dated December 6, 2007. In addition, per the current RFC Reliability Standards Development Procedure, entities may join a Ballot Pool for an individual standard as early as the start of the first posting for comment and continuing through the close of business of the seventh day of the 15-day pre-ballot posting period. The following standards Ballot Pools are currently open for registered entities to join:

- MOD-024-RFC-01 - Verification and Data Reporting of Generator Gross and Net Real Power Capability

Remember, in addition to all NERC standards, all heritage ECAR, MAAC, and MAIN standards that have not yet been replaced by vote of the RFC Board remain in effect.

NOTE: Regarding Mitigation Plans - at the conclusion of the mitigation plan, the Registered Entity must certify successful completion of all actions and tasks as outlined in the accepted mitigation plan and provide sufficient evidence in order for RFC to arrive at a determination of successful completion. In addition, RFC may ask for additional evidence to support successful completion of the accepted mitigation plan, and RFC may elect to perform an on-site review as verification.

    On April 23, 2008, in Docket No. EL08-58-000, the Commission issued a Notice of Complaint regarding the Complaint filed Pepco Energy Services, Inc. ("PES") against PJM Interconnection, L.L.C. ("PJM") on April 22, 2008, alleging that provisions of PJM's Tariff as related to the rules governing the Peak-Hour-Period Availability Charge for infrequently-run generation resources under PJM's Reliability Pricing Model are unjust, unreasonable and unduly discriminatory.

The Commission held that Duquesne Zone generators are external, but PJM may grant point-to-point service on the "parallel" theory, and such service would convert upon transition to MISO.

ER05-1410-000, EL05-148-000, the Commission issued an Order regarding the RPM Buyers' Motion requesting a technical conference to examine the performance of the Reliability Pricing Model (RPM) recently implemented by PJM Interconnection, L.L.C. (PJM). The Commission is requiring PJM to provide information in response to the issues raised by RPM Buyers, and after reviewing the information, will determine appropriate procedures. The Commission orders PJM to (A) Expand the scope of its proposed analysis of RPM and final report; (B) File its proposed June 30 report, upon issuance, as an informational filing in this docket; and (C) File an informational filing in this docket, a summary of the post-report stakeholder proceedings within 15 days of the conclusion of those proceedings.

The CSA facilitates the interconnection of a facility in Millville, New Jersey.

    On April 10, 2008, in Docket No. ER08-569-000, the Commission issued a deficiency notice stating that PJM's proposal to allow unsecured credit for net sellers in the PJM Interchange Energy Market was deficient and requiring further information. PJM is required to provide responses to the Commission's information requests within twenty-one (21) days of the notice.

    On April 10, 2008, in Docket No. ER08-494-000 and ER08-494-001, the Commission issued a letter order accepting for filing PJM's submission of an executed Interconnection Service Agreement (ISA) and an executed Construction Service Agreement (CSA) between PJM, Lookout WindPower, L.L.C. and Pennsylvania Electric Company, a FirstEnergy Company, effective December 28, 2007, as requested. The ISA facilitates the interconnection of a generating facility in Somerset, PA and the CSA provides for the construction of the facilities necessary for the interconnection.

    On April 9, 2008, the Commission issued a Letter Order, in Docket No. ER07-576-005, accepting the Baltimore Gas and Electric Company's ("BG&E") filing of the revised Attachment H-2A tariff sheets to PJM's Tariff to comply with the Commission's November 16, 2007 Order. The tariff sheets reflect the Commission's approval of a 100 basis point return on equity ("ROE") adder for BG&E's investment in the single Northwest-to-Finksburg and five Downtown Cable transmission owner initiated projects, bringing the ROE for these six projects to 12.3 percent. The revised tariff sheets satisfactorily comply with the requirements of the November 16, 2007 Order. The tariff sheets are effective June 1, 2007.

    On April 9, 2008, the Commission issued a Letter Order, in Docket No. ER07-583-004, accepting the Commonwealth Edison Company and Commonwealth Edison Company of Indiana, Inc.'s ("ComEd") filing of the (i) revised Attachment H-13A tariff sheets to PJM's Tariff for the ComEd pricing zone, and (ii) a detailed description of the accounting treatments related to the inclusion of 100 percent of CWIP associated with Phase II of the West Loop Project in rate base, to comply with the Commission's Order on January 18, 2008. The revised tariff sheets satisfactorily comply with the requirements of the January 18, 2008 Order. The tariff sheets are effective May 1, 2007.

    On April 9, 2008, the Commission issued a Letter Order, in Docket Nos. ER05-6-104, et al, accepting the Midwest ISO and PJM's March 3, 2008 filing of revisions to their Joint Operating Agreement ("JOA"), in compliance with the Commission's directives in the January 31, 2008 Order. The proposed revisions to the JOA address the allocation of the cost of new cross-border facilities transmission facilities (i.e., facilities built in one RTO but that provide benefits to the other RTO) that are built for reliability purposes. The compliance filing is effective February 1, 2008 as requested.

    On April 4, 2008, the Commission issued an order rejecting PJM's proposed revisions to its Reliability Pricing Model ("RPM"), the competitive auction mechanism administered by PJM to secure its forward commitment of capacity resources. PJM proposed to revise Attachment DD of its OATT, at section 5.10(a)(iv), to reflect its claimed rise in its Cost of New Entry ("CONE") values, one of the two components used to determine its Variable Resource Requirement ("VRR") curve for its RPM auction. PJM also proposed to add a new section 17.7 to Attachment DD, permitting PJM to unilaterally requests its CONE increase for use in its May 2008 RPM auction for the 2011/2012 delivery year. The order rejected the filing because it stated PJM did not adhere to the tariff schedule set forth in its tariff and failed to establish that its proposal to revise that provision is necessary on a one-time emergency basis to ensure reliable service.

    On April 3, 2008, the Commission issued a letter order in Docket No. ER08-570-000, accepting revisions to PJM's Credit Policy, Attachment Q of the OATT, to permit PJM to accept, in the course of its evaluation of the creditworthiness of its Members, guaranties from entities located in foreign countries, provided that each of the guarantors, the host country, and the guaranty itself meet specified criteria. The revised tariff sheets are effective April 15, 2008, as requested.

    On March 31, 2008, the Commission issued a Letter Order, in Docket Nos. ER08-563-000, et al., accepting PJM's filing of an executed nonconforming ISA among PJM, Shaffer Mountain Wind, L.L.C., and Pennsylvania Electric Company. On February 29, 2008, PJM filed an executed revised ISA indicating that the parties had made minor clarifying changes to the ISA. The ISA is effective January 15, 2008 as requested.
  • 03.28.2008 Docket No. PA08-15-000 (PDF)
    On March 28, 2008, the Division of Audits in the Office of Enforcement of the Commission issued an Audit Notice, in Docket No. PA08-15-000, in which it is commencing an audit of PJM. The audit will determine whether the information posted on PJM's OASIS is consistent with the prescribed requirements at 18 C.F.R. Section 37.6 (2008), focusing primarily on the modifications from Order No. 890. The audit will cover the period from March 17, 2008 through the present.

    On March 28, 2008, the Commission issued an Order approving the Section 204 filing that PJM made in January requesting authorization to issue securities in the form of unsecured promissory notes in an aggregate amount not to exceed $115 million. FERC granted the authorization requested by PJM. The authorization is effective for two years, starting on March 28, 2008. Any long term borrowings are exempt from compliance with FERC's competitive bidding and negotiated placement requirements. Waiver is also granted for any short term debt securities. PJM must file a Report of Securities within 30 days after the sale or placement of long-term debt or equity securities or entry into guarantees or assumptions of liabilities.

    On March 25, 2008, in Docket Nos. ER08-376-000, ER08-455-000 and ER08-520-000 (Not consolidated), the Commission issued an Order on Tariff Revisions. The Order accepts PJM's filings regarding revisions to PJM's credit policies with respect to its Financial Transmission Rights (FTRs), which primarily adjust PJM's collateral requirements for participants in the FTR markets in order to better account for the volatility and risk of certain positions. The Order also rejects PJM's proposal to set off a company's FTR default against FTR market revenues that PJM would otherwise have paid to the defaulting company' s affiliates and to apply such affiliates' posted security to the default to the extent that the security relates to the company's FTR positions. PJM must file a compliance filing in response to certain conditions imposed in this order by May 20, 2008.

    On March 21, 2008, in Docket Nos. EL07-56 and EL07-58, the Commission issued an order approving the settlement proposing revisions to the PJM Tariff and Operating Agreement related to the market monitoring unit (MMU) and denying requests for rehearing regarding the September 20, 2007 order. The order also directs PJM to refile the Market Monitoring Agreement and Services Level Agreement as part of the tariff or rate schedules designated pursuant to Order No. 614. The Commission also reaffirmed its finding that PJM did not violate its Tariff.

    On March 21, 2008, FERC issued an order in Docket Nos. While accepting virtually all of PJM's compliance filing, FERC directed PJM within 60 days to file either a justification for its use of a "retirement" assumption in the default rates, or a proposal to calculate default rates in a different manner.

    On April 17, 2008, PJM filed an answer, in Docket No. EL08-49-000, to the complaint of BJ Energy and four other Tower Research trading companies. The complaint requested the Commission to order PJM to pay these companies over $25 million, plus interest. In its answer, PJM showed that the Commission should decline to act on this demand for money, deferring that issue instead to the federal district court in Delaware that has before it PJM's civil complaint (on behalf of its members) for money damages from the Tower Companies far in excess of the amount they seek in their complaint in this Commission docket. PJM also urged the Commission to dismiss the complaint so as not to impair the Commission's ability to order meaningful relief following either its own pending non-public investigation of the Tower Companies, or PJM's pending complaint in Docket No. EL08-44 against the Tower Companies. Within the filing, there is note of PJM's civil complaint filed in federal district court in Delaware. On April 16, 2008, PJM, in its own name and pursuant to authority granted by the PJM members, filed a civil complaint against Tower Research and several of its affiliates and principals (collectively, the "Affiliates." In the Complaint, PJM seeks to recover losses suffered by the PJM membership and damages for harm to the PJM markets arising out of Power Edge's default in the FTR market, the forfeiture of profits derived by the Affiliates from the PJM markets, actual and punitive damages and the cost of suit, plus interest.

Duquesne indicated that it disagrees with PJM's request to the Commission to defer action on requests for rehearing or clarification of the Commission's January 17, 2008 decision on issues relating to the portability of capacity acquired by Duquesne and other LSEs in the Duquesne Zone within PJM as part of the RPM capacity process. Duquesne believes that the Commission needs to address the fundamental portability issues raised by the parties in the rehearing requests.

    On March 31, 2008, PJM submitted revisions to the PJM Open Access Transmission Tariff Amended and Restated Operating Agreement. The proposed revisions modify the manner in which PJM obtains supplemental reserves by implementing a market based procurement mechanism.

    On March 31, 2008, PJM submitted notification to the Commission, in the Dominion Resources Services, Inc. v. PJM Complaint (Docket No. EL08-36-000), that on March 28, 2008, PJM delivered in draft form to the sponsors of the 14 interconnection requests in PJM's "R" queue that are affected by the Settlement the results of PJM's thermal and short circuit analyses for each sponsor's respective project. PJM also delivered the same results in draft form to the affected PJM transmission owners for the purpose of soliciting from them any lower-cost upgrades that may be available to resolve any overloads that PJM's study identified. The notification is in compliance with Paragraph 6 of Appendix A of the proposed Settlement Agreement, which provides that PJM will identify, based on information to be obtained from affected transmission owners on or before April 15, 2008.
