02.08.2008 Docket No. ER08-455-000 (PDF)
On February 8, 2008, in Docket No. ER08-455-000, the Commission issued an Errata of Extension of Time changing the time for filing interventions from February 15, 2008 to February 12, 2008 regarding the January 18, 2008 filing by PJM proposing revisions to the Default Allocation Assessment formula in section 15.2.2 of the PJM Operating Agreement. In addition, following a conversation among FERC staff and counsel for the Tower Research family of companies, today PJM filed a letter requesting the intervention date be restored to February 15, 2008 as the Commission ordered yesterday.

Highlights

New PJM CEO Terry Boston comes on board this month

Terry Boston joined PJM this month as PJM’s new president and chief executive officer. He was named CEO last month after a five-month search by the PJM Board of Managers.

Boston spent his first day on the job meeting PJM employees and visiting their work stations. “I look forward to meeting and working with each of you and learning from you. I hope you share my optimism about the future,“ Boston told PJM employees. “We’ be working on some of the toughest problems in the industry involving reliability, load growth, generation resource adequacy, transmission planning and siting, market performance, pricing . . . and the list goes on.”

Boston joined PJM after a 35-year career at Tennessee Valley Authority where he served in recent years as the executive vice president of TVA’s Power System Operations. He was the senior officer responsible for the TVA’s transmission and power supply network of 17,000 miles of transmission infrastructure. Boston assumed the post held on an interim basis by Karl V. Pfirrmann, who now serves as PJM’s executive vice president.

Boston led TVA’s efforts to develop formal arrangements with neighboring utilities and regional transmission organizations in creating a transmission network to preserve reliability and enhance wholesale electricity markets.

Boston is a member of the Power Delivery & Utilization Council’s executive committee of the Electric Power Research Institute. He also served three years as chairman of the SERC Reliability Corporation’s board of directors and executive committee. He has served for six years on the North American Electric Reliability Council’s Engineering Committee and Transmission Task Force, and is on the NERC Board/Stakeholders Committee. He was one of eight industry experts selected to direct the NERC investigation of the August 2003 Northeast/Midwest blackout. He is vice president of the International Council on Large Electric Systems and vice president of the Consortium for Electric Reliability Technology Solutions.

RPM auction results for 2010-2011

The fourth PJM base residual auction for capacity using the Reliability Pricing Model continued the trend of increased generation and demand resources available to serve consumers. The fourth auction was for the planning year June 2010 through May 2011.

The combined results of the four base auctions show the net minimum increase in capacity was 10,000 megawatts (MW) compared to what would have been available absent RPM, according to Ott. The combined results also show that there was 3,228 MW of generation offered in as capacity that either was previously scheduled to retire or was generation that was reactivated.

“For this auction by itself we saw the largest net increase in capacity since we began the RPM auctions,” said Andrew L. Ott, PJM vice president-Markets. “We added a net 1500 megawatts of resources.”

The recent auction produced a clearing price for most of the PJM region of $174.29 per megawatt-day. The clearing prices for the previous delivery year, 2009-2010, were $237.33 in the Baltimore-Washington area, $191.24 in the Mid-Atlantic region and $102.04 in the western portion of the PJM market area.

Prices were reduced in the Baltimore-Washington and Mid-Atlantic areas and increased in the western portion of the region due to capacity exports and load growth.

In this auction, only the Delmarva Peninsula south of the Chesapeake and Delaware Canal was constrained. The RPM clearing price there is $186.12.
The current auction results show a continuing trend in more demand resources offered as a capacity source. The current auction offered in 936 MW of demand resources for the RTO--up from 906 MW in the last auction.

The next base residual auction will be in May 2008 for the delivery year 2011-2012.

    On February 7, 2008, in Docket No. EL07-63-001, the Commission issued an Order granting Motion and Dismissing Complaint and Request for Rehearing in the matter of Strategic Transmission, LLC v PJM Interconnection, LLC regarding the Project S16. The Commission previously denied Strategic's complaint, in part, addressing the Incremental Capacity Transfer Rights for Strategic's merchant transmission Project S16, but directed PJM to provide the project cost and Upgrade Construction Service Agreement for Project 16. The Complaint and request for rehearing have been dismissed and FirstEnergy's motion to dismiss has been granted as moot because Project S16 is no longer being pursued.

    The Federal Energy Regulatory Commission granted an extension of time up to and including February 15, 2008 for filing motions to intervene, comments or protests regarding PJM's January 18, 2008 filing proposing revisions to the Default Allocation Assessment in the PJM Operating Agreement. This extension provides additional time to facilitate ongoing discussions between Tower Research, its affiliates, and PJM.

    On February 6, 2008, in Docket No. ER08-350-000, the Commission issued a Letter Order accepting PJM Interconnection, LLC's December 17, 2007 compliance filing, which was initially filed with Docket No. ER07-1186-001. The filing addresses Amendments to the PJM Open Access Tariff Schedule 12 Appendix to reflect the assignments of cost responsibility for at or above 500 kV RTEP facilities.

    On February 6, 2008, in Docket Nos. EL08-8-000, -001, the Commission issued an Order designating the presiding Administrative Law Judge, Judith A. Dowd, clarifying procedural deadlines and scheduling a prehearing conference for February 13, 2008 in the matter filed by the Mirant Energy Trading, LLC, et al., against PJM. In an effort to issue the Commission's final decision by the December 4, 2008 agenda deadline and prior to the January 9, 2009 Third Incremental Auction, the Commission decided it was necessary to begin hearing procedures while continuing settlement negotiations.

("Dominion") against PJM in which Dominion is alleging that PJM failed to timely process Dominion's interconnection request in accordance with the PJM Tariff. In addition, the Settlement Judge is to provide a settlement status report on or before February 22, 2008.

    On February 5, 2008, in Docket No. EL08-8-000, the Commission issued an Order Scheduling a Settlement Conference for March 3, 2008 in the matter filed by the Mirant Energy Trading, LLC, et al., against PJM regarding the application of mitigation in Third Incremental Auctions in RPM.

    On February 4, 2008, in Docket No. EL08-36-000, the Commission issued an Order establishing Settlement Judge Procedures in the matter filed by Dominion Resources Services, Inc. ("Dominion") against PJM in which Dominion is alleging that PJM failed to timely process Dominion's interconnection request in accordance with the PJM Tariff. In addition, the Commission is requesting a status report on or before February 22, 2008. The due date to file interventions, comments, protests and answers remains February 11, 2008.

    On February 4, 2008, the FERC issued the attached Letter Order in Docket No. ER08-55-000 approving proposed revisions to the Congestion Management Process ("CMP") of the PJM/Midwest ISO Joint Operating Agreement ("JOA"). These proposed revisions to the CMP, jointly filed by PJM and Midwest ISO on October 15, 2007, as amended on December 7, 2007, are the result of changes that have been agreed upon by a majority of the Congestion Management Process Council (i.e., Midwest ISO, PJM, Southwest Power Pool, Inc. ("SPP") and the Tennessee Valley Authority ("TVA")), and are based upon CMP documents that have also been executed by and between Manitoba Hydro and the Midwest ISO; MAPPCOR and the Midwest ISO; SPP and the Midwest ISO; and PJM, TVA and the Midwest ISO.

    On January 31, 2008, in Docket No. EL07-101-000, et al., the Commission issued an order denying the AEP Complaint and denying the request to consolidate the AEP complaint with the ongoing proceedings in Docket No. ER05-6-100, et al. The Complaint and this order is made in response to a filing made on August 1, 2007, by PJM, certain of the PJM Transmission Owners (PJM TOs), Midwest ISO, and certain of the Midwest ISO Transmission Owners (Midwest ISO TOs), in compliance with the Commission's directive in Docket No. ER05-6-000, et al., for a reevaluation of fixed cost recovery policies for pricing transmission service between Midwest ISO and PJM. In the August 1, 2007 compliance filing the parties submitted their Independent RTO Pricing Design (IRPD), a proposed methodology for pricing transmission service between the RTOs effective February 1, 2008. In its complaint, AEP asked the Commission to consolidate the AEP Complaint with the IRPD proceeding. This order finds the existing license plate rate design just and reasonable and should continue.

    On January 31, 2008, in Docket Nos. ER05-6-044, EL04-135-046, et al., the Commission issued an order accepting the Midwest ISO proposal to allocate costs for cross-border planning reliability projects. The Commission directs PJM and the Midwest ISO to submit a compliance filing, within 30 days of the date of this order, that includes revisions to their JOA consistent with the changes that the RTOs jointly proposed and agreed to in their March 21, 2006 filing, and that incorporates the changes that Midwest ISO proposed in its April 20, 2006 filing. The Commission also directs the RTOs to submit in the compliance filing revisions to the applicable sections of the JOA so that the physical rights to any incremental capacity on existing reciprocal coordinated flowgates created as a result of a new cross-border facility are assigned to each RTO, for congestion management purposes, in proportion to the share of the costs that each RTO must pay under the cross-border cost allocation process. Finally, regarding cross-border planning economic projects, the Commission also directs the RTOs to file a proposal to allocate the cost of economic cross-border projects no later than August 1, 2008.

("ISO-NE"), et al. ("collectively, "Respondents"), alleging that the Respondents improperly processed a queue for transmission service on the Phase I/II HVDC-TF.
