On July 22, 2008, PJM filed a Motion to Intervene, under Docket No. ER08-1190-000, in which the RPL Holdings, Inc. filed with the Commission for approval of its rate schedule for providing Reactive Power to the natural gas and oil fired cogeneration facility located in Elmwood Park, New Jersey. The facility is interconnected with the transmission system, owned by the PSE&G, and is under the operational control of PJM.

Highlights

PJM's Boston Tells Senate Transmission Key to Achieving Energy Goals

PJM President and CEO Terry Boston testified July 31 before the U.S. Senate Energy and Natural Resources Committee that transmission is the enabler of virtually all of the energy goals Congress is considering.

Providing solutions to achieve those goals, Boston said, "will require more transmission infrastructure whether it involves increasing renewable generation, using more nuclear power, shifting to clean coal technology with carbon sequestration or relying on more plug-in hybrid electric vehicles."

Boston's prepared testimony stated that to adopt some of the ambitious renewable energy and climate change goals that are being discussed will require a substantial investment in new transmission and new grid technology. He added that the electricity industry can deliver, as it has done in the past, but only if it can get beyond debate over yesterday's issues and instead partner with the states, the federal government, consumers and industry to focus on truly deploying the 21st century grid.

"For a decade following the New York blackout of 1965, this nation and this industry came together and built transmission that made electric reliability in the U.S. the envy of the world from the mid-1970s through the mid-1990s," Boston said. "To earn that status again, we must take control of our own destiny on energy adequacy and reliability. By working together with the states we can do it again."

Market Monitoring Unit Becomes External Entity

On August 1, the Market Monitoring Unit (MMU) officially transitioned to an external firm independent of PJM. In March, the Federal Energy Regulatory Commission (FERC) approved a December 2007 settlement agreement that put an external firm, Monitoring Analytics LLC, in charge of market monitoring services for PJM.

Joseph Bowring, the former internal Market Monitor, heads Monitoring Analytics, which now is located in the same building complex as the PJM Business Center at 2621 Van Buren Ave., Suite 160, Valley Forge Corporate Center.

MMU evaluates the operation of PJM's wholesale markets to identify ineffective market rules and tariff provisions, identifies potential anticompetitive behavior by market participants and provides the comprehensive market analysis critical for informed policy decision making.

Stakeholders Discuss Brattle Recommendations

PJM stakeholders met on July 31 in Wilmington, Del., to discuss recommendations about the Reliability Pricing Model (RPM) contained in a report by The Brattle Group.

The morning session was opened by N.J. Board of Public Utilities Commissioner Fred Butler along with a panel of stakeholders who discussed RPM and their organizations' and sectors' positions on the various Brattle recommendations. Following the presentations, the panelists fielded questions and comments from about 180 other stakeholders at the meeting and on the conference line. Although the speakers' views of RPM differed, generally they complimented the PJM stakeholder process and the openness to consider changes to RPM.

In the afternoon session, Andy Ott, PJM senior vice president - Markets, summarized stakeholder feedback on the priority to be given to RPM issues. The stakeholder group will then discuss methods to set priorities for short-term and long-term RPM modifications. Afterwards, Ott will facilitate a discussion to set the process for the stakeholder dialog on RPM modifications.

Along with Butler, the morning's panelists were Gloria Ogenyi, Pepco Holdings Inc.; Jesse Dillon, PPL; Paul Peterson, Synapse Energy; Neal Fitch, Reliant Energy Inc.; Tom Rutigliano, Consumer Power Lines; Steve Naumann, Exelon; Mark Scott, Gen Power Holdings; Robert O'Connell, JP Morgan; and Robert Weisaar, PJM Industrial Customers Coalition.

PJM commissioned Brattle to analyze the RPM base residual auctions held to date, assess whether the RPM is achieving its objectives and to recommend modifications to the RPM. With the release of the report, PJM initiated a stakeholder review, including today's session, of potential changes to RPM based on the Brattle findings.

The RPM is designed to ensure that electricity providers have enough capacity to reliably serve the 51 million consumers in the PJM region. PJM members that sell electricity to end-use customers can use generation, transmission or demand response, including energy-efficiency programs. They can meet their supply requirements by owning resources (self-supply) or contracting for them (bilaterals).

TrAIL Project Update: Line Gets First State Approval

The West Virginia Public Service Commission (PSC) August 1 approved plans by a subsidiary of Allegheny Energy to build the Trans-Allegheny Interstate Line (TrAIL) in West Virginia, subject to a series of conditions.

The transmission line, targeted for completion in 2011, would cross Allegheny Power's transmission zone from southwestern Pennsylvania through West Virginia to the Meadow Brook substation near Middletown, Virginia. Dominion Virginia Power would build the line from an interconnection point east of Meadow Brook to its Loudoun substation. The project was included in PJM's Regional Transmission Expansion Plan in 2006.

The PSC order requires that the line be approved by regulators in Pennsylvania and Virginia before construction can begin on the West Virginia portion of the project. The order also approves a settlement agreement reached previously by Trans-Allegheny Interstate Line Co. (TrAILCo), the staff of the PSC, the West Virginia Consumer Advocate Division and the West Virginia Energy Users Group. The settlement provides a series of benefits for the state, including employment commitments, programs for low-income customers and rate relief for industrial customers.

The West Virginia segments of TrAIL represent the largest portion of the project, which is awaiting regulatory decisions in Pennsylvania and Virginia. In July, a hearing examiner in Virginia recommended that regulators in that state authorize construction of the Virginia segments of TrAIL, subject to approvals in West Virginia and Pennsylvania.

As Temperatures Rise, Members Rise to the Challenge

From July 17 to July 19 the PJM region experienced a heat wave that exceeded the forecast, extending until July 22. Temperatures remained high afterward.

The demand on the grid peaked at 129,500 megawatts (MW), on Thursday, July 17. However, PJM - with the cooperation of its member organizations - did not encounter any problems in maintaining power supplies.

The all-time peak for PJM was 144,644 MW, set on Aug. 2, 2006.

Demand Response Steering Committee (DRSC) Meeting

PJM Vice President of Federal Government Policy Craig Glazer discussed states' approvals of retail customers participating in PJM's demand side response (DSR) programs at the Demand Response Steering Committee meeting July 29.

The issue is lack of clarity regarding state approval of retail customer participation in the Federal Energy Regulatory Commission-approved PJM Demand Side Response program. At this meeting, Glazer identified the need to clarify the process for state determination for approving/disapproving retail customer participation.

At the meeting, an opt-in and opt-out option was discussed as well as proposed tariff revisions. The next DRSC meeting is scheduled for September 5. The PJM presentation is available here.

- NERC Files First Set of Enforcement Actions into the U.S. for FERC, Reliability Improvements Underway - On June 4, 2008, NERC submitted the first set of Notices of Penalty in the U.S. to FERC to approve under Section 215 of the Federal Power Act. These notices, publically available on NERC's website, document which reliability standards are violated and the actions taken by the companies involved, assuring future compliance and improving reliability.

The initial set included 37 notices and 106 violations, the majority of which were documentation-related and did not include a financial penalty.

The total value of financial penalties assessed equaled $255,000: one $180,000 penalty and one $75,000 settlement agreement. All financial penalties were related to violations of NERC's FAC-003-1 standard titled "Vegetation Management."

46% of the individual violations submitted were regarding documentation of reporting procedures for CIP-001-01 (Critical Infrastructure Protection: Sabotage Reporting). The next two most violated standards were PRC-005-1 (Protection and Control: Transmission and Generation Protection System Maintenance and Testing) and FAC-008-1 (Facilities Design, Connections, and Maintenance: Facility Ratings Methodology). - NERC Issues Reliability Advisories on February Florida Outage: The analysis of the February 26, 2008, category four system disturbance in Florida has led to the release of three industry-wide reliability advisories available here.

- On July 18th, NERC transitioned to an entirely new nerc.com. The new site, while incorporating a number of features that significantly improve the user experience, is ultimately a work in progress. A number of the features have been requested, such as an RSS feed, are due to be implemented in upcoming development phases.

Unfortunately as a result of this change, many of the web addresses for the documents on nerc.com have changed. NERC will attempt to leave the majority of ftp:// links active for 30 days from the launch of the new site.

- NERC Reliability Standards Development Plan Annual Update - The NERC RS Development Plan (Plan) is a three-year plan used by NERC staff to identify and prioritize the reliability standard development projects in the immediate three-year horizon. Comments on the plan were solicited via a web form through the middle of July so that a draft revision can be presented to the industry via a webcast in early August.

- First Quarter 2008 Vegetation-Related Transmission Outage Report Posted - NERC released its first quarter 2008 Vegetation-Related Transmission Outage Report on June 16, 2008. There were a total of 14 "Category 3 - Fall In" outages, but zero "Category 1 and 2" outages. This represents a significant jump from first quarter 2007, where only 5 outages were experienced due to "fall ins." The report can be found on the NERC website here.

- CIP-002 through CIP-009 RSAWs Posted; Updated CIP-001 RSAW Posted - The RSAWs can be found on the NERC website here.

- Webinars - NERC presented a Webinar on July 16th to share three examples of excellence in focusing on the important issue of attracting and retaining talent in the electric industry. As noted in NERC's 2007 Long-Term Reliability Assessment, the aging workforce and high retirement rates are projected to be a major challenge to reliability over the next ten years. A full text version of examples will be published shortly here. Please see the June 2008 NERC News for additional information related to Workforce Planning, Workforce Relations, and Employee Recruitment and Development on page 5.

- Training News: New Operator Certification Examinations began July 7 - NERC launched a new system operator certification on July 7th. The 2008 Study Guide on NERC's website offers an in depth explanation of the new types of questions. An overall study guide and individual content outlines for the new examination are also available on the System Operator Certification website here.

Regarding Standard PRC-002-RFC-01, Disturbance Monitoring Equipment - The Standard Drafting Team is in the process of responding to all comments received through the Category Ballot. Once the SDT has formally responded to all comments, the ballot results will be confirmed and publicly posted.

Regarding Standards MOD-024-RFC-01 and MOD-025-RFC01 - Generator Verification and Data Reporting - The SDT is responding to comments received.

Regarding Standard BAL-502-RFC-02, Planning Resource Adequacy Analysis, Assessment and Documentation - The SDT will be meeting on August 7-8, 2008, in Chicago to respond to all comments received from the first 30-day comment period that ended on July 23, 2008.
Meetings
The Reliability committee (RC) will have an August 14, 2008, meeting at the Baltimore Marriott, Washington International Airport Hotel in Baltimore, MD. The major agenda items may be to endorse the long-term resource and transmission assessments.

In response to a directive from the RFC RC and as initiated by PJM, the Operating Committee agreed to form a working group to develop guidelines for TOP and BA coordination as required in standard EOP-005. The purpose of these guidelines will be to enhance reliability by improving and documenting the coordination of restoration plans. Miscellaneous
RFC's Compliance Portal went live on June 24, 2008. The next submittals for self-certification to the NERC/Regional Standards outlined in the updated 2008 Compliance Monitoring Schedule are due on September 26, 2008. The applicable standards for each entity will be placed on the portal sixty (60) days prior to their due date to allow adequate preparation time for compliance submittals. Registered entities are to continue using the registration forms available on the RFC website. These forms are being revised to align with the implementation of the Portal. Please note that RFC has the sole authority to change a company's legal information and functional designation on the Portal and will notify NERC of any applicable changes and will update the information on the Portal upon receiving the submittal form. An entity has the authority and is responsible for assigning and revising the Master Account Administrator (MAA), Compliance Officer - Primary and Authorized Signatory information in the Portal system. Therefore, when any of these roles within a company are changed, it is the MAAs responsibility to update the Portal with the name and contact information to ensure, going forward, that the proper personnel are receiving information from RFC.

    On July 18, 2008, in Docket Nos. ER05-1410 and EL05-148, the Commission accepted for filing, subject to conditions, PJM's compliance filing concerning the use of avoided costs rates for default bids in PJM's Reliability Pricing Model (RPM) Program. The Commission accepts use of a mothballing assumption as the default calculation, while permitting use of a retirement assumption in particular demonstrated cases. The Commission has directed PJM to incorporate additional protections, as discussed in the order, to prevent abuse of the retirement assumption. PJM will make these changes in a compliance filing within 30 days.

The Commission further ordered PJM to file a report with the Commission on the outcome of the stakeholder process by the earlier of 12/31/08 or 30 days after the conclusion of that stakeholder process.

    The Commission issued the an Order on July 2, 2008, in Docket No. ER08-928 accepting PJM's Local TLR procedures effective on July 8, 2008, as requested. Because PJM's plan to implement the Local TLR procedures requires agreements with other parties, the Commission directs PJM to file a schedule of parties adopting PJM"s local TLR procedure within 60 days of this Order. PJM is also required to file a schedule with the Commission updating the parties adopting PJM's local TLR procedures on an annual basis. The Commission also directs each VACAR South Member adopting PJM's local TLR procedure to file, within 60 days of this order, revised tariff sheets adopting PJM's local TLR procedures.

    On July 1, 2008, the Commission issued an Order, in Docket Nos. ER08-884-000, et al., approving the JOA CMP revision of the market flow threshold from 3 to 5 percent effective June 1, 2008 as requested. The Commission directed a compliance filing in 15 days requiring that the CMP appendix include specific terms and conditions that apply to the field test. This requirement was previously fulfilled with CMP language referencing a joint compliance filing letter dated August 23, 2008, in Docket No. ER07-940-000. That language, however, was subsequently removed when PJM and MISO made JOA changes to adopt standardized CMP language.

    FERC issued an Order Accepting Tariff Sheets today for the revisions to PJM's Attachment Q Credit Policy filed on Feb. 15, 2008, subject to conditions. Specifically, the Commission accepted the proposed tariff revisions, effective April 15, 2008, but conditioned this acceptance on PJM filing a revised First Revised Sheet No. 523G.01 because the Commission deemed this provision to be ambiguous in that it does not make clear whether PJM would requirement payment of additional security that it has requested on the same day of the request or whether the additional security must be paid within three days of the request. Commissioner Wellinghoff issued a dissent in this matter, agreeing with AEP that the proposed tariff modifications could result in a greater number of defaults than otherwise would occur. He further stated that "PJM has not demonstrated sufficient benefits to consumers of its proposal to justify that increased risk and possible costs."

    On July 22, 2008, PJM filed a Motion to Intervene, under Docket No. ER08-1190-000, in which the RPL Holdings, Inc. filed with the Commission for approval of its rate schedule for providing Reactive Power to the natural gas and oil fired cogeneration facility located in Elmwood Park, New Jersey. The facility is interconnected with the transmission system, owned by the PSE&G, and is under the operational control of PJM.

The formula rate will, among other things, replace PSE&G's historic Annual Transmission Revenue Requirement with a formula rate construct consistent with comparable methodologies accepted by the Commission for transmission owners within PJM.

    On July 11, 2008, PJM filed its answer to the complaint of the RPM Buyers in Docket No. EL08-67. In their complaint, RPM Buyers ask FERC to find that the RPM transition auction clearing prices for the Delivery Years of 6/1/08 through 5/31/11 are unjust and unreasonable, and to order a reduction of about 50% in the revenues to capacity resources committed in those auctions. In its Answer, PJM asked FERC to dismiss the complaint because the requested relief violates the filed rate doctrine, because it is a collateral attack on FERC's prior RPM orders, and because the requested relief would harm forward markests and is contrary to FERC's policy not to order the re-running of markets. PJM also showed that the Complaint lacked substantive support, including that the complaint did not present even a prima facie case that any RPM clearing prices had been increased by an exercise of market power.

    On July 3, 2008, the ISO/RTO Council ("IRC") submitted reply comments in Docket No. AD08-7-000, captioned as Annual Charges Assessments for Public Utilities. The IRC provided the reply comments to ensure that (1) the Federal Energy Regulatory Commission ("Commission") had a complete and an accurate record to assess the positions taken by parties in this proceedings, and (2) the issues before the Commission were properly framed in light of some extraneous issues that were presented by commenters opposing any reform in the method currently used by the Commission to allocate the costs of its regulatory program. The IRS reiterated its proposed initial comments that the Commission must develop some mechanism for recovering reliability-related costs from all "users, owners and operators of the bulk power system," including non-RTO/ISO members and similar entities.

    On June 30, 2008, PJM filed Tariff and Operating Agreement changes in Docket No. ER08-780 in compliance with FERC's 5/30/08 order in the proceeding, which concerns PJM's Day-ahead Scheduled Reserves proposal. The compliance filing consisted of changes addressing how batch load demand resources can provide day-ahead scheduled reserves, similar to the manner in which they currently can provide synchronized reserves.

    On June 27, 2008, PJM filed revisions to Section 6A.2.1 of Schedule 1 of the Operating Agreement, as well as the parallel provisions of Attachment K-Appendix of the PJM Tariff, and revisions to the Table of Contents for the Operating Agreement and Tariff. These revisions add a new, APSouth Scarcity Pricing Region and make corrections to headings and page numbers in the Table of Contents of the Operating Agreement and Tariff.

    On June 25, 2008, PJM submitted for filing, in Docket No. ER08-1163-000, an executed service agreement for network integration transmission service under the PJM Tariff. The service agreement ("AEP NITSA") is between PJM and American Electric Power Service Corporation as the agent for Appalachian Power Company, Columbus Southern Power Company, et al. PJM also filed a Notice of Cancellation for a service agreement that is being superseded by the AEP NITSA. PJM requested May 27, 2008 as the effective date.
