Highlights

Brattle issues report on RPM, recommends changes

On June 30, The Brattle Group issued its study on the Reliability Pricing Model (RPM), the capacity market approach that PJM implemented in 2007. PJM commissioned Brattle to analyze the RPM base residual auctions held to date, assess whether the RPM is achieving its objectives and to recommend modifications to the RPM.

PJM is initiating a stakeholder review of potential changes to RPM based on the Brattle findings.

"The release of the Brattle report launches an important examination of the RPM through stakeholders' assessment and review of the report's findings, including their discussion of its recommendations for changes to RPM," said Terry Boston, PJM president and CEO. "In the meantime, PJM will continue to reach out to all interested parties to better understand their resource adequacy needs and issues."

The Brattle Report offers the following conclusions about the RPM results to date:

  • The first five base auctions have been successful in achieving the reliability and economic objectives of RPM as defined in the RPM settlement agreement reached in September 2006.
  • The RPM has attracted and retained more than 14,500 megawatts (MW) of resources that likely would not have been available otherwise. These resources include new generation, up-rates to existing generation, new demand response, decreases in committed net exports, withdrawn requests to deactivate plants and canceled or deferred retirements of generating plants.
  • The RPM has helped stimulate the proposed construction of numerous new generation projects, of which approximately 33,000 MW are already eligible to offer into future RTO auctions.
  • The RPM also assists in retaining more than 20,000 MW of existing resources that likely would not be financially viable in the absence of capacity prices.

The report calls for maintaining the basic design elements of the RPM, but it recommends that PJM and its stakeholders consider various changes, including changing certain market rules and design elements to increase the pool of resources able to offer capacity into the RPM, revising penalties imposed on electricity providers that do not fulfill their capacity commitments and improving processes to maintain and cost effectively provide reliability in areas with transmission constraints. The Brattle Group report also recommends other changes to the RPM which it will present to PJM stakeholders on July 11.

On July 31, PJM will hold a stakeholder forum to discuss the report's recommendations. An on- going stakeholder process is expected to emerge from that meeting.

PJM made an informational filing with the Federal Energy Regulatory Commission (FERC) that includes the Brattle Report. The PJM information filing is available at the PJM Web Site at Documents > Recent FERC Materials > FERC Documents. As directed by the FERC, the filing points out where the Brattle Report addresses issues raised by the RPM Buyers Group.

The filing also contains a second attachment. In the attachment, the Market Monitoring Unit addresses three of the issues raised by the RPM Buyers Group.

Committee proposes changes to credit requirements

Credit Risk Management Steering Committee (CRMSC), consisting of PJM members, presented preliminary recommendations this month to improve managing credit risk in PJM Markets. The initial recommendations were also discussed at the Market Implementation Committee, the Markets and Reliability Committee, the Board Competitive Markets Committee, the Liaison Committee and the Members Committee. The recommendations are not expected to be voted on by members until at least August 7.

Among the recommendations are changes to accelerate the settlement process, give PJM authority to terminate and liquidate financial transmission rights (FTRs) and retain current unsecured credit provisions. An additional initial recommendation is to establish minimum participation requirements, including $1 million minimum tangible net worth as well as mandatory virtual bidding and FTR training. The minimum tangible net worth requirement discussed in the CRMSC was proposed by PJM's members for consideration, not PJM.

"PJM is concerned about the impact of the potential minimum participation requirements on current PJM members who consistently have complied with PJM market rules and credit requirements," said Suzanne Daugherty, vice president, chief financial officer and treasurer. However, as these recommendations continue to proceed through the stakeholder process, the outcome presented to the Board of Managers will reflect the best interests of all of PJM's members, who will have participated in the discussions and voting, she added.

The final CRMSC recommendations will be prepared after the July 21 CRMSC meeting and will be advisory to the PJM Members Committee who may vote on some or all of the recommendations August 7. The Members Committee recommendations would need to be considered by the PJM Board of Managers before any revisions might be proposed to the FERC.

Boston and Bowring provide review of PJM's wholesale market to FERC

PJM President and Chief Executive Officer Terry Boston and Market Monitor Joseph Bowring presented a review of PJM's performance in the wholesale electricity market from an historical perspective as well as an operational perspective Tuesday to the Federal Energy Regulatory Commission (FERC) in Washington, D.C.

The presentations were made at a FERC conference, Review of Wholesale Electricity Markets, which assessed the current and future states of regional wholesale electricity markets.

Boston and Bowring participated on a panel with the CEOs and market monitors of ISO New England and the New York ISO. Other panels included the California ISO, Midwest ISO and Southwest Power Pool and industry leaders from the southern and western regions.

"Speaking for PJM, I believe we have the firm foundation of a fully integrated operations and market model that is flexible enough to embrace change yet resilient enough to stand for the core elements of regional transmission organizations: independence, transparency, openness and fair treatment for our constituents," Boston said.

Bowring discussed PJM's pricing history and trends and agreed that PJM and the Market Monitoring Unit are working well together and working toward a smooth transition to having the Market Monitoring Unit become an external independent entity to be completed by this fall.

Both provided written testimony to FERC in advance of their presentations, which provided more details on how reliability is achieved in PJM, particularly through wholesale electricity markets. First big heat wave in the PJM region

Beginning on June 7, much of the PJM region faced sustained high temperatures during its first major heat wave of the season. The temperatures rose to the mid and high 90s during the three days that followed. Although temperatures and demand were higher for June, PJM and its members were able to meet demand.

Demand was especially high on June 9, hitting a peak of 135,000 megawatts (MW). However, the peak did not surpass last summer's peak of 139,428 MW. PJM has a committed capacity of 159,780 MW for the entire summer. Load was monitored and managed closely, particularly in the congested Baltimore-Washington area.

Through PJM's Reliability Pricing Model (RPM), there is 4,460 MW of emergency load management available for this summer. This has doubled from the amount available in 2007. PJM's reserve capacity is 19.7 percent--a figure based on its committed capacity.

The heat wave ended on June 10 when thunder storms affected areas of PJM and cooled temperatures. However, storms also resulted in some unexpected problems as a few regions experienced outages at the local distribution level.

FERC receives briefing on rising electricity costs

The members of the Federal Energy Regulatory Commission (FERC) received a briefing from the agency's Office of Enforcement on increases in electricity costs. Noting that forward market prices are much higher this year than actual prices in 2007, the analysis warns that the current situation may foretell "significantly higher power prices that will last for years."

The following are some of the key points in the Office of Enforcement's analysis:

  • Two main factors are driving up the costs of electric generation: higher fuel costs and increased construction costs. These factors are affecting all parts of the country, so that higher prices in the future will affect all regions.
  • High fuel prices are the main driver of this year's increasing electricity prices, with natural gas prices expected to remain strong and coal prices rising sharply over the last year. Because coal generally is bought under long-term contracts, there may be a lag before the impact is reflected fully in power prices.
  • The increasing cost of new construction will put upward pressure on electricity prices because of the need to invest in new generation to meet demand growth, with "a significant level of demand increase . . . virtually inevitable."
  • Capital costs for generation construction have nearly doubled since 2003, reflecting global demand for basic commodities and shortages of engineers and other professionals with expertise in construction. Prices for such commodities as iron and steel, cement and metals like copper have increased sharply.
  • Uncertainty about the outcome of the climate change debate in the U.S. is having an impact, particularly with respect to investments in coal-fired plants.
  • "Natural gas will be crucial" over the next few years to help the nation meet its need for new capacity. "The lead times for both nuclear and coal units mean that they will not supply a significant amount of new capacity for nearly a decade."
  • The response to high electricity prices is likely to include increased demand response, a focus on energy efficiency and technological innovations.

NERC

- Per the May 2008 NERC News, NERC projected electricity will be reliable over the coming summer months in their annual 2008 Summer Reliability Assessment.

- In response to questions about its Critical Infrastructure Protection (CIP) standards implementation plan, NERC published a document providing guidance to the industry on when penalties and sanctions can apply. The implementation plan specifies two levels of compliance - "compliant" and "auditably compliant" and the clarification provided confirms that requirements become enforceable at the "compliant" stage which is as early as July 1, 2008, for 13 requirements per Table 1 of the implementation plan.

- Compliance audits of the CIP standards will not begin until July 1, 2009, but self-certification of compliance may apply based on the requirement and the implementation timeframe.

- Regarding the approval of reliability standards, the key to gaining FERC approval of a standard is meeting specific criteria, especially FERC's "15 points of justification." In FERC Order 672, the Commission identified the criteria it will use to analyze standards that NERC proposes for approval. The criteria ensure the proposed standard is just, reasonable, not unduly discriminatory or preferential, and in the public interest. As such, when a filing is developed, it uses the record of the standard's development to justify that each criteria is met. The 15 points of criteria follow:
  • Proposed standards must be designed to achieve a specified reliability goal;
  • Proposed standards must contain a technically sound method to achieve the goal;
  • Proposed standards must be applicable to users, owners, and operators of the bulk power system, and not others;
  • Proposed standards must be clear and unambiguous as to what is required and who is required to comply;
  • Proposed standards must include clear and understandable consequences and a range of penalties (monetary and/or non-monetary) for a violation;
  • Proposed standards must identify clear and objective criterion or measure for compliance, so that it can be enforced in a consistent and non-preferential manner;
  • Proposed standards should achieve a reliability goal effectively and efficiently - but does not necessarily have to reflect "best practices" without regard to implementation cost;
  • Proposed standards cannot be "lowest common denominator," i.e. cannot reflect a compromise that does not adequately protect bulk power system reliability;
  • Proposed standards may consider costs to implement for smaller entities but not at consequence of less than excellence in operating system reliability;
  • Proposed standards must be designed to apply throughout North America to the maximum extent achievable with a single standard while not favoring one area or approach;
  • Proposed standards should cause no undue negative effect on competition or restriction of the grid;
  • The implementation time for the proposed standards must be reasonable;
  • The standard development process must be open and fair;
  • Proposed standards must balance with other vital public interests; and
  • Proposed standards must consider any other relevant factors.
- NERC is currently working on more than 35 standards development projects.

- NERC Training: NERC has developed online courses that are available to trainees 24/7. Once course that is available is Fundamentals of Auditing for NERC Compliance Audit Team Members. On April 30, 2008, NERC released an advanced online module for both audit team leaders and audit team members called Gathering Quality Evidence. This module goes into detail about what constitutes sufficient, adequate, and appropriate evidence during a compliance audit. There are several real-life examples and a case study in the module.

- NERC has also been developing e-learning modules for the NERC Readiness Evaluation volunteers. Upcoming training will include modules on Advanced Skills for Compliance Auditors and Advanced Skills for Readiness Evaluators.

- Please be advised that the 2008 Compliance Monitoring Schedule self-certification and survey due date for the CIP Standards has been revised to accommodate NERC's monitoring schedule for these standards. The due date for both the self-certification and the survey has been changed to July 15 as discussed earlier in this report section.

- NERC issued its very first set of notices of penalty for confirmed violations of reliability standards. In general, the violations were reflective of a growing culture of compliance across the industry because by far, the majority of the violations stemmed from companies self-reporting infractions.

- The Reliability Committee (RC) will have a meeting on August 14, at the Baltimore Marriott, Washington International Airport Hotel in Baltimore, MD. RFC will be sending out a meeting notice soon.

- The Operations Subcommittee (OS) will hold a conference call on Thursday, July 10 from 2:00-3:30 ET.

- Regarding Standards/Guidance on CIP Standards: RFC recommends that each Registered Entity review the "Guidance for Enforcement of CIP Standards" letter and the Implementation Plan for Cyber Security Standards as soon as possible, so that registered entities can determine how this issue will affect your organization.

- Revised Schedule: ReliabilityFirst's 2008 Compliance Monitoring Schedule self-certification and survey due date for the CIP standards has been revised to accommodate NERC's monitoring schedule for these standards. The due date for the self-certification and survey has been changed to July 15. Submittals of the self-certification questionnaire for the CIP standards will be done via the new compliance reporting system (RFC Portal) which is now available.

- PRC-002-RFC-01, Disturbance Monitoring Equipment: Please be aware that the SDT for this standard has responded to all comments received during the previous numerous 30-day comment periods. The ninth draft of the PRC-002-RFC-01 is currently posted for the required 15-day period prior to Category Ballot which began June 11, 2008. Once the 15-day pre-ballot posting is completed, the 15-day Category Ballot is expected to begin June 26, 2008. Per the RFC Standards Development Procedure, entities may join the ballot pool for this standard.

- NAESB standards will enable the Commission to make use of a tariff database which will also provide functionality for the public to view and research tariffs, and also provides companies the flexibility to design to purchase software for making tariff filings the best fits their business needs.

- Demand Side Management - Energy Efficiency: For the wholesale electric market, more than 40 distinct programs administered by ISOs and RTOs have been identified with program characteristics defined in a matrix. The entries in the matrix will provide the foundation for preparing standards. The draft standards should be available for subcommittee consideration in the 3rd Quarter 2008.

- Order No. 890 and OATT Reform: NAESB WEQ Subcommittees are working diligently to meet FERC deadlines. NAESB was to file Available Transfer Capability (ATC) related standards no later than August 7, 2008, but the FERC has granted an extension of the deadline to November 27, 2008. To date, work is complete on ATC/TTC narratives, load forecast and actual load. ATC information link, data exchange for ATC modeling, transmission reliability margins, ATC and AFC calculation methodologies, standards to complement NERC supplemental SAR: Revisions to Existing Standards MOD001-MOD009, FAC12-113, and postbacks and counterflows for the ATC related items.

The proposed revisions modify the Financial Transmission Rights ("FTR") auction rules in the PJM Interchange Energy Market ("PJM Market") by establishing a long-term FTR auction process ("LTFTR Auction"). This LTFTR Auction will enable Market Participants to purchase and sell: 1) FTRs with terms longer than one Planning Period; and 2) single Planning Period FTRs effective for future Planning Periods that occur after the Planning Period in which the LTFTR Auction occurs. These revisions are consistent with the Commission's desire to allow for the procurement of long-term transmission rights, as well as flexibility in the design of their long-term firm transmission right process.

    On May 28, 2008, in Docket No. AD08-7-000, the ISO/RTO Council ("IRC") provided comments in response to the Federal Energy Regulatory Commission's ("FERC" or "Commission") Notice of Inquiry ("NOI") regarding Annual Charges Assessments for Public Utilities. The IRC respectfully requests that the Commission reevaluate its annual charge regulations and adopt a methodology that mitigates the discriminatory impacts associated with the current methodology. The IRC stands ready to work with the Commission and all stakeholders in the development of a NOPR designed to institute much needed and long overdue reforms in this area.
